1. Agreement to These Terms
By placing an order, submitting payment, or purchasing any product from Top Notch Sports LLC (“Top Notch Sports,” “we,” “us”), you (“customer,” “buyer,” “you”) agree to be bound by these Terms & Conditions. If you do not agree, do not place an order. These Terms form a binding contract between you and Top Notch Sports and apply to every order, invoice, and payment.
2. Custom, Made-to-Order Products — All Sales Are Final
Every Top Notch Sports product is custom manufactured to order to your specifications (your colors, logos, names, and numbers). Because each item is produced uniquely for you and cannot be resold, all sales are final and non-refundable once your design mockup is approved and production begins. By approving your mockup and submitting payment, you acknowledge and accept that your order is a custom, made-to-order purchase with no right of cancellation, return, exchange, or refund.
3. Free Mockup & Design Approval
We provide a free digital mockup with unlimited revisions before production. Production does not begin until you approve your final design. You are solely responsible for reviewing and confirming all spelling, names, numbers, colors, logos, sizing, and design details on the approved mockup. Once you approve, the design is final and you accept responsibility for its accuracy.
4. Minimum Order
A minimum of 10 items is required per order (mix and match any items toward the minimum). Pricing reflects custom team manufacturing and is provided on your invoice or at checkout.
5. Payment & Authorization to Charge
Full payment is due at the time of order unless otherwise agreed in writing. By submitting payment, you represent and warrant that you are the authorized holder or authorized user of the payment method used, and you expressly authorize Top Notch Sports to charge the full order amount, including the item total, a $25 flat-rate shipping charge, and a 3% processing & handling fee. This authorization, together with your order record and mockup approval, constitutes your consent to the charge.
6. No Unauthorized Chargebacks — Dispute Resolution
You agree that if you have any concern about your order, you will contact Top Notch Sports directly first at shop@topnotchsports.us or 210-556-4824 to resolve it, and that you will not initiate a chargeback, payment dispute, or reversal before giving us a reasonable opportunity to respond. You acknowledge that Top Notch Sports products are custom, made-to-order goods and that, once your mockup is approved, payment is made, and the order is produced and delivered or made available to you, the transaction is complete, authorized, and final. You expressly agree that initiating a chargeback or payment dispute on custom goods that have been produced, delivered, and/or accepted is a breach of this Agreement and constitutes an unauthorized attempt to obtain goods without payment. In the event of such a chargeback, you agree that Top Notch Sports may (a) submit these Terms, your order record, your mockup approval, your authorization to charge, and proof of production and delivery as conclusive evidence that the charge was valid and authorized; and (b) recover the full disputed amount, any chargeback and bank fees incurred, and all reasonable costs of collection, including attorney fees. You further agree that retaining, using, or failing to return delivered products while pursuing a chargeback constitutes acceptance of the goods and payment obligation in full.
7. Shipping, Title & Risk of Loss
A $25 flat-rate shipping charge applies to each order. Title and risk of loss pass to you upon our delivery of the goods to the carrier. Production and shipping timelines are estimates that begin after design approval and payment; Top Notch Sports is not responsible for carrier delays. Delivery of the order to the address you provide, or your acceptance of the goods, completes the sale.
8. Sizing
Please use our published size guide before approving your order. Because all items are custom made to order, they cannot be returned or exchanged for sizing. Confirm all sizes on your mockup; approving the mockup confirms your sizing selections.
9. Returns, Refunds & Defects
Because all products are custom made to order, we do not accept returns, exchanges, cancellations, or refunds, except in the case of a verified manufacturing defect or an error caused solely by Top Notch Sports. Report any defect within 7 days of delivery, with photographs, to shop@topnotchsports.us. Our sole obligation for a verified defect is, at our option, to remake or repair the affected item. Variations inherent to sublimation and custom manufacturing (minor color, placement, or dye variation) are not defects.
10. Fraud Prevention & Record Retention
To protect both parties, Top Notch Sports retains order records, mockup approvals, payment authorizations, communications, and proof of production and delivery. You represent that all information you provide is accurate and that you are legally authorized to use the payment method and to submit any artwork, logos, or designs. Orders that appear fraudulent, unauthorized, or made with a payment method the customer is not authorized to use may be canceled or reported.
11. Intellectual Property
You represent and warrant that you own or have the right to use any logos, names, artwork, or designs you submit, and that they do not infringe any third-party trademark, copyright, or other right. You agree to indemnify and hold Top Notch Sports harmless from any claim arising from the designs you provide.
12. Limitation of Liability
To the fullest extent permitted by law, Top Notch Sports’ total liability for any claim relating to an order is limited to the amount you paid for that order. Top Notch Sports is not liable for indirect, incidental, or consequential damages.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute arising from or relating to an order or these Terms shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to that jurisdiction and venue.
